Hi-
My current EAD was issued in 2007 when I filed I-485 + I-140 concurrently. It has since expired. I did not apply for a renewal because I am still on my H1B.
I am applying for a renewal now and had a question regarding filling out form I-765
Q15. Current Immigration Status ( Vistor, Student, etc )
I am still on my H1B. So I think I should write H1B and not AOS. But I am not sure.
I filled (C)(9) for Q16 Eligibility Criteria, and since I live in Ohio I am sending it to USCIS Phoenix Lockbox Facility. My receipt notice is Aug 2007 and to be sure I am including the $380 fee.

I got GC under EB2, I'm planning to start my own business. is there any risk factors if i leave my employer right after getting GC and change the Field of intrest?

You can definetly start any bussiness you want. As per the link below it seems it will be safe to stay with the current employer for atleast 6 months.

I obtained an H1B visa through Company A (starting October 2008) and the H1B visa was valid until September 2011, unfortunately in March 2009 I was laid off. As a result to maintain my status I switched from an H1B visa to a B1/B2 visa. I actually went to my home country and got the visitors visa from the consulate in my home country. In July 2009 I returned to the USA and entered the USA as a visitor on a B1/B2 visa.
My question now is what happens if I obtain employment. What does my new employer have to do? Since my initial H1B approval is valid until September 2011, can by new employer just take over the H1B without me having to go through the lottery system again even though currently I am on a visitors visa and have been unemployed for more than 3 months?

--What would you do to improve composition?
--How would you crop it differently?
--Would you have done something different in post-processing?
--What is your honest opinion of the image?

I have approved I-140 with PD MAY07 awaiting date to be current to file I485, now my company is moving to a new address,

That was taken last October on the Island of Dominica at a place called Emerald Pool (believed to be the "fountain of youth" by the locals). The girl in the pic is my girlfriend's sister and didn't mind playing model for me. :)
I'll try to find a color shot of the pool and waterfall for you. Very nice place, buried in the rain forest.

I recently returned from an international trip (flew into JFK), and the only document that the CIS officer asked for was my AP. Based on what my lawyers had said, the only 'required' document is your AP, although it probably doesn't hurt to have copies of the LC, I-140, I-485 (more for peace of mind!).

If your company pays for there own lawyer then go ahead and change it to new one. As the response from lawyers will be fast. And you can avoid big expenses if you retain earlier law firm. Keep in mind Lawyers charge for each and every thing they do.
I did this and recently gave G28 for new lawyers. (But when my H1 was transfered new company lawyers goofed up the office address and I have not yet received I797 any how this is a different story. Planning to apply for a copy)
Why I am reluctant to go with new guy is due to EVL content.
Old guy knows abt the case and prepare the letter accordingly.
My concern is...if I retain old guy... Is it legal to pay expenses from my pocket?

I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question

b) Replacement
c) Renewal of my permission to accept employment
I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response
Please advise.....

I filed my EAD online for the first time on May 9th. Yesterday I got an approved card for my wife and I. It is interesting how fast that came and that I did not need to send pictures nor did I go for fingerprinting. My initial finger printing and picture taken for 485 was used to give me the EAD
However, NSC issued the EAD for 1 year only. I called up help desk and asked them why 1 year and not 2 years. They checked their records and saw I was eligible for 2 year, then they transferred me to Level 2 support. The Level 2 support after looking at my case, put me on hold for sometime and then came back and said, the period of EAD was done at the discretion of NSC. So if I do not want it, I should send it back and ask them to reopen my case.
Guys any advise or should I wait for 1 year and hope next year they will issue a 2 year EAD?? I really do not want to send my EAD back...

My spouse and I have been notified through I-797C notice of action letter of the interview for (form-1-485, application to register for permanent residency). They require us to bring along a checklist of items for the interview including form I-864 that needs to be attached with Tax returns and W2 or certified IRS printouts.
Both of us have been in US for 15 years holding F1 and later H1B visas. The problem is that one of us (who is the dependent) has worked in several organizations without authorization. We would like to know what cause of action to take to mitigate the problem as well as the worst-case scenario in terms of our ability to obtain residency. Any advice, particularly those who know of someone who has faced a similar situation will be appreciated.

This is simple posturing and nothing more. Hispanic caucus CANNOT bring down healtcare reform. They have as much invested in the healthcare bill as anybody else in the Congress. They way I see it, this equates to a sucide threat if my friend won't shot at the enemy. All this to make a show to the hispanic population that hispanic caucus is doing something to push for the immigration bill. Nothing more. I would not weigh-in too much on this news item because its not for my consumption. This news is for the consumption of hispanic voters only.

I-140 doesn't belong to the employee. Period.
Then ownership of I-140 needs to change as well. Maybe this is something we could all work in the long term.... and not an immediate goal at this time. Of'course this will need help from everybody on the forums. Something like this is sure to help all of us.

The moment the H1B is approved, your friend is on H1B. L1 gets automatically cancelled when the H1B is approved. This is what I am told when it happened to me. But in my case, both L1 and H1B are done by the same company. If they are different companies, I am not sure how it works.
