1)My I 94 expires in 2 months.I don't want to extend H1 and I want to use EAD.So how can I extend my I94 if I start using EAD?
2)I finished 4yrs of stay on H1B. If I don't extend H1B now and start using EAD, if by any reason my 485 denies in future, can I switch back to my H1B and work for the remaining 2yrs on H1B?

The New York Times published a poll this week that only 30% of Americans would like to see the twelve million illegally present immigrants in the US deported. And 65% would like to see them legalized either on a temporary basis or given a path to eventual citizenship. In fact, while the number wanting to see legalization dropped by one percent since the same question was asked in late 2007, a significantly higher percentage polled preferred a path to citizenship versus temporary status. For all of those saying that the public won't accept legalization during a severe economic downturn, the...

My PD is Feb 2008 and my I-140 has been approved the same year. I am on my H-1b 3 yr extension.
If I were to change my job now, will I lose my PD or can the new company refile my new I-140?

Immigration Visa Attorney Blog Has Just Posted the Following:
The H-1B quota is slowing reaching its limit. The so-called advanced degree cap is now full and approximately 53,800 cases have been counted against the 65,000 allocated to the regular cap. USCIS has advised that those wishing to be counted against this year's cap should submit their applications as soon as possible.
A lot has been said about how much longer the H-1B quota has lasted this year. There's a been a lot of speculation about the reasons why the quota is still open. It's pretty obvious that the economic situation has led to a reduced number of filings, but less people talk about the other reason. USCIS is generally pretty skeptical about the H-1B program, believing that many candidates for H-1B are filing marginal cases. This has increased the number of requests for evidence that USCIS has issued this season as well.
While the open cap provides an opportunity for a late-season submission, H-1B applicants and their employers should be well aware of the scrutiny they may have to endure. Working with advocates like the attorneys at Fong & Chun, LLP will ensure that you have a candid opinion before you make the decision to file an H-1B and how you can make a difference in your chances by simply being educated about the H-1B process.
Anyone wishing to file an H-1B case should call the attorneys at Fong & Chun, LLP for a free consultation and realistic assessment of their case. ---ecf

First of all, congrats to everyone in the final stages of this tedious and frustrating process.
I have a question for people who filed I-140 and I-485 concurrently and got their receipt numbers.
I have gotten receipt numbers for my concurrently filed I-485 and I-765 as I paid for them (PD April 2003, I-140/I-485 filed at NSC). I do not have receipt for I-140 after more than 2 weeks. My employer is not giving me receipt number for I-140 as he may be wanting more money from me. Now, I have read in a forum that I-140 when applied concurrently should have receipt number very close to I-485 receipt number and normally I-140 receipt number is less than I-485 receipt number (i.e. if I-485's last four digits are 4600 then last 4 for I-140 number will be lower than 4600 and close to it. So, in theory I can scan numbers prior to mine and find closer ones for the same date and track them.
If you can please check your numbers and tell me if your I-140 number is before your I-485 number and how close they are to each other, I would really appreciate it.
Thanks in advance.

This is interesting that he works in Tancredo's office . Its good that law is working to catch such racists.
Another point to note is that this guy said the N word and all this happened. Lou Dobbs will lose his job the next day if he starts making comments against the African American community. These guys do not even dare go in that territory. We all know what happened to Don Imus. Now If you just replace 'Indians'/immigrants/H1B with the N word, all these anti-immigrant organizations, websites and anti-immigrants will find themselves in a very difficult situation with the law. Civil rights activists will also not let them continue their hatred.
It is high time Indian Americans and immigrants start raising this issue actively and end such racism.

I have my AP approved H1 valid till 2009 but stamp expired. If I marry a non us resident and bring her on H4 and Myself enter in US using AP. Does it mean that my H1 is invalidated?
Does it mean that my wife's H4 will be invalidated also and she becomes out of status since my H1 is invalidated?
Or I am completely wrong here?
I can't file her 485 since my PD is not current and also I cant have h1 restamped cause it takes way long to get it stamped.
Any Idea?

Thanks.

Hi,
I came in US on 5-Jun-2006 on L2 visa & then changed status to H4 after 6 months & then applied for H1 & started working & now I'm on H1 & now I want to go back to H4. I never left the US during these change of status from L2 --> H4 --> H1
The Part 3 of form I-539 is asking below questions:
1. I/We request that my/our current or requested status be extended until***** (mm/dd/yyyy): __________
Here, actually, I'm applying for change of status & not extension. Should I write N/A or the I-94 expiry date of my spouse's H1 petition?
2. Is this application based on an extension or change of status already granted to your spouse, child, or parent?
Here, should I say Yes or No??
3. Is this application based on a separate petition or application to give your spouse,*child, or parent an extension or change of status?
Here, should I say Yes or No?
I would really appreciate if you can help me, Ginnu!!!
Thanks again in Advance!!!
Regards!
