I think someone has given you incorrect information.
A visitor can stay for a maximum of 6 months (180 days - unless person is given earlier date in I-94, which is not usual) At a stretch. If person returns before 180 days, he/she can come back within a day and get a new I-94 and again can stay for 6 months (180 days or the date written on new I-94).
So, person's stay is not governed by number of days in a year, but by the date which is written on I-94. As long as she gets new I-94 with new date, she can stay until that date.
As a side note, what you are confusing with is the tax requirements, which is: If you are claiming a person to be your dependent, he/she must have stayed in the country for atleast 6 months in a calendar year.

Last week i received the letter about my RFE for my I140 which they received on Feb 8, 2007. I'm a EB3 category from Bangladesh.

Hi,
I am working under H1B visa and got married December last year. My wife applied for her H4 visa this month and when she got to the embassy for the interview, the consul checked and commented on the font size of her address in our marriage certificate. She said it was smaller than my address (well, she got a longer address before we got married, maybe that is why the census made it smaller) and said to my wife that it needs verification. The embassy then took all documents (her passport, our original marriage cert, etc.) and said they will call her when she needs to return for interview again.
Has anyone of you experience this? If so, any ideas how long it takes for them to call? BTW I'm Filipino. Thank you guys and God bless

Gurus,
I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

Whether it is LCA for H1 or PERM labor for GC it is location specific, unless one filed(or able to file) AC21 after July '07 fiasco, you need to have labor to a specific job to the specific location you will be working.
Either job or the location changes you need to start allover again, in some cases you can recapture (or port) your priority date.

To all IV members and the core team:
Thanks a bunch for mobilizing members to get their voices heard - first at the historic San Jose rally of high-skilled legal immigrants, and now with this monumental effort in DC on September 18th.
Thanks to all your efforts (myself included), we were able to file for Adjustment of Status (AOS), EAD and AP in July, and had the extension till August 17th to file it for those of us who couldn't do it sooner.
Thanks also to the lawmaker(s), and others who voiced their opinions and drew attention to the plight of highly educated, skilled, tax-paying, brilliant, and entrepreneurial folks, waiting for their GCs for as long as a decade.
We finally received our EADs yesterday, and our APs have been approved (awaiting notices).
The road from here to finally becoming permanent residents and perhaps eventually citizens of this great country (for those of us who wish to) is a long, winding one, full of tricky situations, significant risks, and the inevitable delays by the agencies concerned.
We all need to collectively make our voices heard, tell the lawmakers, the media, and the world about our lives that we continue living in limbo, and will be forced to do so for a long long time if we don't act.
I WILL ENTHUSIASTICALLY JOIN THE DC RALLY NEXT WEEK.

hi,
i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?

There are two phases to this fight. The first phase has less to do with us and more to do with waiting for the dust to settle. We have to wait till the end of the elections for getting a clear perspective of what our approach should be. It looks like the lame duck session will be short and we will be very lucky to have anything done.
The second phase is to start contacting congress men after the elections and push the momentum to have something passed.
In the meantime we have to keep creating more awareness among people about this problem. It requires patience and you have to keep frustration and negativity out. As you can see there are plenty of people who are ready to spew negativity at the slightest provocation. The way I see it, we do not have an option to fall to negative sentiments. We have to fight this out no matter what the odds.

IV Members,
At some point of time you must have posed a question or had some issue that was pegging you. You tried to get answers from members and resolve issues. Time must have passed and you had an outcome for the issue you were worried/working. It would be nice if you post the experience what happened to the issue you were worried over the period of time. How it has been resolved or what is logical end.
For ex:
I posted a question about my worry about travel to india with out the reciept notice and finally it ended up recieving the notice 3 days before my travel. I have gone through different tensions in the process. IV forums helped me understand where I stood what actions I needed to take. I took those actions, and it resulted in a favourable outcome at the end.
This happened just because some one has posted their experience.
So it is just not posing the questions on the forums but as the time passes do update what happened to your question.
This helps many other IV members who may come across same situations. Some of the IV members do this but few others they just forgot to return back and update the members what happened to their situations later. Do care to let people who answered you know what was the result.
